AMITY Techsys reserves the right to modify the Content of this document as
and when required without any prior information. Agreeing to
amitytechsys.com Acceptable use Policy and Terms of Conditions is mandatory
for our services signing up or using our services. Please make sure you read
everything. Do Contact us for any questions. QUOTES & CONTRACTS Quotes provided to prospects will be honored for 10 days. A new quote will then be provided upon request. Contracts that have been written, but not signed by the client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request. CHARGES & FEES We require a 50% non-refundable deposit in order to begin work on any project, with the remaining balance due when the project is complete, but before it goes live. If final payment is not received within 7 days of the completion of service, additional fees will be added. Any check payments that do not clear will be charged a Rs. 250/- fee. HOURS OF OPERATION Our business hours are clearly posted on our contact page. If you require work after the posted hours, such as on weekends or holidays, the additional charge are applicable as per effort and will be added to your bill. WEB SITE DESIGN CREDIT AMITY Techsys Web Design works hard to create custom websites for a wide range of clients. We take great pride in every site we create, and feel that having our name on the sites we design will also deter others from copying our work and marketing it as their own. Therefore, we reserve the right to place a visible link to AMITY Techsys Web Design on every site that we create and any site that uses the graphics we create. This is not optional and may not be removed. DELIVERY OF CONTENT This agreement assumes that CLIENT will provide all text in electronic format (.doc, .pub.txt, or .wpd) on computer disc, email or made available by ftp. All photographs and other graphics are to be provided in high quality print suitable for scanning or on a computer disc in a standard graphic format (TIFF, JPEG, GIF, BMP, or PNG). All computer discs will be returned to the CLIENT upon job completion. Text on typed pages is acceptable but CLIENT will be charged a transfer fee of Rs. 200/- per page of text. COPYRIGHT Copying images, text or design layouts from other sites is not condoned by AMITY Techsys Web Design. We ask that you, our client, only provide us with text, images and products that you own or have expressed written permission to use. Under NO circumstances will AMITY Techsys and it's owners, partners or contractors be held liable for content provided by a client on a client website. As the client, you will pay any and all legal expenses that are a result of lawsuit against AMITY Techsys for graphics, images and/or content which is provided by and used by the client. It is the sole responsibility of the CLIENT to obtain all necessary permissions and authorizations with regard to the use of all copy, graphic images, company logos, trademarks and or any other supplied material. Every contracted work will be seen as a guarantee that all such permissions have been obtained. REFUNDS Website design is a combination of two things- the web designer's time, and the finished product. AMITY Techsys Web Design requires a deposit of 50% on all web design projects before we begin on any project. If you decide to terminate your contract with AMITY Techsys Web Design, we will hold the deposit as a cancellation fee therefore, it will not be refunded to you. Once a site has been completed and live, there are no refunds. In the event of a cancellation of contract, ownership of all artwork, layouts and development remain copyrighted to AMITY Techsys Web Design and will not be transferred to the client. DELIVERY AMITY Techsys Web Design works hard to complete all projects in a timely manner. We will provide you with an estimated time of delivery for your project. However, we do not guarantee deadlines as each project is unique and so is each customer. We will communicate with you during the entire development of your project and provide you with status updates. Please understand that additional services, revisions to design or development of your site and delays in providing us with the information we require will significantly add to the delivery time. NON-COMMUNICATION If we are unable to communicate with a client on a project for a duration of 45 calendar days by phone or email during the design and development process, the project will be canceled without prior notice and no refund of the deposit will be issued. OUR GUARANTEE TO YOU AMITY Techsys Web Design guarantees to you that every website and ecommerce store we develop will be fully operational and working without glitches, bugs or other errors upon delivery. If your site or ecommerce programming has been edited by anyone other than an employee of AMITY Techsys Web Design, this guarantee is then voided, and charges for editing the site will be applied at our hourly rate. We will always advise you of and seek permission for changes to your website and the charges that will be applied before any work is completed. Notice: This Agreement shall be governed by and construed in accordance with the laws and jurisdiction of the city of Bangalore. ACCEPTANCE Please note that by submitting your down-payment for services you are agreeing to all of our terms of service as written here. AMITY Techsys Web Design reserves the right to change or update these terms at any time without notice. ACCESS & RIGHTS AMITY Techsys must be granted access to the server directory where the design is to be placed. By signing this agreement, it is also granting AMITY Techsys full "on demand" access to the installed files. CLIENT further agrees that AMITY Techsys shall have the right to remove "our" design from public view for failure to adhere to the terms of this agreement. These could include violating licensing agreement or failure to pay fees duly assessed. RIGHT OF REFUSAL AMITY Techsys reserves the right to refuse service for any content deemed inappropriate, illegal or immoral. AMITY Techsys may cancel this agreement for failure of CLIENT to abide by these terms. "SUBMITTED FOR YOUR APPROVAL" AMITY Techsys will post all site work done to our server for review by CLIENT. This will allow the CLIENT an opportunity to review the appearance and content of scripted material. All custom programming and custom graphics including logos, animations and flash programming provided for CLIENT per the original contract will be considered as part of the finished product even if the CLIENT decides not to use. If the CLIENT request changes outside the limits of original contract, CLIENT agrees to pay AMITY Techsys web design fees on a per hour basis. Unless AMITY Techsys is notified via email within ten (10) days of posting review, AMITY Techsys will consider the material deemed acceptable by the CLIENT. Payment of the fee balance will then become due. MAINTENANCE PLANS AMITY Techsys will provide maintenance plans for CLIENT at a predetermined fee if said CLIENT request said plan. If CLIENT requests any changes above and beyond the original contract, said CLIENT will pay AMITY Techsys at the normal effort based design rate. SUBJECT TO CHANGE ACCEPTANCE OF TERMS Placing an order or contracting AMITY Techsys for web design or graphic design will be regarded as acceptance of these Terms and Conditions. Placing an order with AMITY Techsys can initially be done by email but must be confirmed by postal mail which will include a signed copy of this agreement. |
